Session’s description:

Criminal law policy is one of the principal strategies aimed to protect society, state and each individual. Nevertheless, little attention has yet been drawn to this institute, and criminal law development vectors are beyond a clear paradigm of the elaborated instruments, proceeding occasionally and embedding chaotically new forms and structures into criminal law, which result in reasonable doubts about their appropriateness. When reflecting on these novelties, excessive detailing often cannot be avoided without recognizing beyond those details any global goals and objectives that were defined when reforming the legislation. However, we believe that the cause of all the problems is the lack of a clear system-centric approach to conceptualization of the criminal law policy for decades to come. In this regard, it is proposed to discuss our perception of this policy, specific aspects we should touch upon and any possibilities to consider the projects and proposals in this field already here today.

Session’s description:

Information security has become one of the world’s biggest problems, the solution of which should not only be found in the legal background but primarily justified by the burgeoning technologies. Managing these technologies as a matter of law is a subject of reasonable complexity due to the asynchronous development of technologies and law. The technologies are known to move far ahead, and the law is forced to adapt to this rapid development. Today it can be safely said that the technologies are not merely a blessing but also the root of many evils. Among them are identity theft, embezzlement, dissemination of prohibited content in the information space and more. However, the technologies may also cause physical damage. Cyberattacks and explosive-laden drones have become commonplace. In this regard, the UN Special Committee discussion of the Convention on Cyber Security proposed by the Russian Federation should be deemed positive; it is also proposed to discuss new challenges associated with the military use of technologies, as a part of interstate relations as well.

3:10–4:30 p.m. Parallel session: Criminal Law Protection within the Military Security of the State

Session’s description:

Military legal security as a basis of the national sovereignty has been in an untouched state for quite a long time. These circumstances are due to the peaceful skies above our heads following the bloodiest war of the twentieth century that claimed the lives of over 25 million Soviet citizens. However, the historical spin has shown that the diplomacy mechanisms capable of ceasing any conflict and existing in different state and interstate systems have stopped being efficient, and challenges have undergone quantitative and qualitative changes. New challenges are characterized by an entirely different nature, which thus requires an alternative response from the state, primarily by using legal instruments. For this reason, the legislators have urgently adopted a series of measures designed, on the one hand, to restrict the citizens’ rights and, on the other hand, to ensure the state’s military security and sovereignty as a whole. In this respect, it is proposed to discuss the aforesaid changes and their relevancy, as well as the established law enforcement aimed to achieve the goals and objectives that were set out by the legislators in enacting these changes.

Session’s description:

In the context of special circumstances, sanctions pressure, and active military actions within the Special Military Operation, the protection of relations arising from government contracts takes on increasing importance. In this regard, the governmental control over the state defense procurement is becoming increasingly significant. This aspect has predetermined the criminalization of certain actions, as well as the active use by the Prosecutor General’s Office of the Russian Federation of its powers within the framework of civil law in respect of the forfeiture to the state of property complexes in the form of enterprises that have exhibited a corruption basis at acquisition or have been acquired in violation of privatization rules, which is a typical example of the forfeiture inherent to criminal law. In this respect, it is proposed to discuss constituent elements of the innovated deeds and the problems of their characterization, as well as the state’s actions associated with the forfeiture of property.

4:50–6:10 p.m. Parallel session: Legal Security of Economy under Sanctions Pressure

Session’s description:

Sanctions pressure is not something new in the world community. Nevertheless, the legal basis for sanctions has become increasingly controversial arising from none other than unpredictable and, which is the most crucial point, sudden and often arbitrarily politicized authorities’ decision directed against the economy of a particular state. The Russian Federation has been subjected to historically unprecedented sanctions, with a vast deal of agreements between subjects of entrepreneurial activity forcedly terminated, which causes discontent of both Russians and our colleagues abroad. However, the effect of the sanctions on ordinary citizens also causes concern. These unjustified measures may include visa bans, which result in the violation of human rights to freedom of movement, freezing of funds in accounts and impossibility of their transfer, which restrict human rights to property, and many other breaches. In this respect, it is proposed to discuss the legitimacy of application of sanctions in the absence of any legal grounds and using political aspects as a basis of the aforesaid sanctions, the admissibility of violation of the universally recognized human rights in imposing the sanctions, as well as whether compensation is mandatory in case of such groundless restrictions.
